Rules and Regulations

Qualified Entry and Entrant

·         Qualified entrants will be restricted to: 

(a)   Local government recreation departments who input data on the BC Activity Reporter (www.bcactivityreporter.com) between June 8 and August 31, 2009

(b)   Organizations that have submitted facility data for the Hosting BC website (www.HostingBC.ca) between June 8 and August 31, 2009 using the Hosting BC Content Management System User Guide as a guideline. These organizations are:

o        Municipal facility operators (Recreation Departments)

o        Private facility owner/operators

o        Destination Marketing Organizations (Tourism boards)

o        Other legal entities which own, operate or manage sport facilities in British Columbia or are responsible for the promotion of Sport Tourism in their community.

·         Registrants who enter through HostingBC.ca will be eligible to submit one entry per facility, approved by 2010 Legacies Now, uploaded into the Hosting BC database, up to a maximum of 50 entries.

·         Registrants who enter through the BC Activity Reporter will be eligible to submit one entry per each whole year of data (for 2006 to 2008 inclusive) or half year of data (Jan. 2009-June 2009) inputted into the BC Activity Reporter database, to a maximum of four entries.

·         2010 Legacies Now will contact all Qualified Entrants and provide them with access to the Contest website.

·         All Entrants must agree to provide 2010 Legacies Now with their contact information (organization, city, email address, phone number, postal code and name of contact person) in order to be entered into this Contest. Such information will be used exclusively for the purpose of allowing 2010 Legacies Now to conduct the draw and will not be shared or sold to any third party.

·         To be declared the Winning organization, the selected Entrant must first correctly answer, unaided, a time-limited, mathematical skill-testing question posed by telephone to the designated contact person at a mutually convenient time; and will also need to return a signed acknowledgment form relating to compliance with contest conditions.

·         2010 Legacies Now rulings are final and without appeal in all matters related to the promotion and the awarding of the prize.

·         2010 Legacies Now reserves the right to withdraw entries should duplicates or false information be found.

Contest Period and Contest Deadline

·         The Contest Period runs June 8, 2009 to September 30, 2009.

·         The required entry form must be submitted online by the Contest Deadline, which is 11:59 pm PST on September 30, 2009.  All portions of the entry form must be completed.

How to Enter

There are two ways to become eligible to submit entries for this contest:

1.      Input data on the BC Activity Reporter (www.bcactivityreporter.com)

2.      Upload facility data on Hosting BC (www.hostingbc.ca)

 

·         No purchase necessary.

·         Qualified Entrants will be notified by email by 2010 Legacies Now that they are qualified to enter this contest and receive website directions.

·         To submit an entry for this contest, Qualified Entrants must visit the contest website to fill out and submit online the prescribed entry form.

o        If entering the contest through the  BC Activity Reporter, a Qualified Entrant can submit its eligible number of Qualified Entries by completing, for each desired entry, the online entry form and submitting it to 2010 Legacies Now between June 8, 2009 and September 30, 2009.

o        If entering the contest through Hosting BC, only one entry form is required by Qualified Entrants and Hosting BC will submit subsequent entry forms on their behalf; by submitting online the first contest entry form, the Entrant agrees to Terms and Conditions in all subsequent entries made by Hosting BC.

·         2010 Legacies Now is not responsible for lost, late, damaged, illegible, stolen, misdirected, misidentified, postage due or incomplete entries, for any problems or technical or mechanical malfunction of any telephone systems, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by 2010 Legacies Now on account of technical problems or traffic congestion on the Internet or at any website, or inaccurate entry information, whether caused by equipment, programming used in this Contest, human processing or otherwise, or any combination thereof.

·         Written, video and photo entries become the property of 2010 Legacies Now and may be used for promotional purposes of 2010 Legacies Now relating to this contest or otherwise.

Random Draw

·         Contact particulars of all qualified entrants for each qualifying entry submitted will be compiled by 2010 Legacies Now for the purposes of conducting a random draw.

·         A draw to select one (1) Winning Organization from among the Qualified Entries will be made by an independent audit firm on behalf of 2010 Legacies Now on October 16, 2009 or as soon as practical thereafter from all qualifying entries received prior to the contest deadline.

·         Upon the winning entry being drawn, the 2010 Legacies Now representative will certify and declare that the entrant assigned to that entry is the Winning Organization if such entry and entrant meets these Contest Conditions. If not, another entry shall be selected. An entry or entrant not meeting these Contest Conditions shall be disqualified. Any disqualified entry or entrant cannot win a prize.

·         The Winning Organization wins one (1) prize.

Prize

·         The prize is: 

·         A prize package to be utilized by a Designated Representative of the Winning Organization, consisting of:

o        Two tickets to the Men’s Alpine Skiing Downhill at the 2010 Olympic Winter Games.

o        $1000, if the Winning Organization is located outside of the Whistler area and the Greater Vancouver Regional District only, to be used for travel and accommodation costs associated with attendance at the Men’s Alpine Skiing Downhill by the Designated Representative and their guest. 

·         Travel arrangements will not be made by 2010 Legacies Now and will be the responsibility of the Designated Representative and their guest.  The Men’s Alpine Skiing Downhill tickets are valued at $300 and can not be resold or transferred to another organization or person.  Possession and use of the tickets is subject to the terms and conditions established by the Games organizers.  The approximate value of the prize package is up to $1,300. 

·         The prizes are non-transferable and non-assignable. 

·         The Winning Organization may not auction, raffle, sell, transfer, barter or exchange these prizes or any portion of them in any manner whatsoever.

·         The Winning Organization must report within 10 days of being notified as the Winning Organization to 2010 Legacies Now on the selection of an eligible individual as the Designated Representative.   The Designated Representative must be either: 

(a)   a director, employee, or volunteer of the Winning Organization; or 

(b)   an individual who is a verified recipient of or participant in programs or services offered by the Winning Organization and supported by 2010 Legacies Now.

·         The following are disqualified as Designated Representatives :

(a)   Directors and employees (and their family members) of 2010 Legacies Now and the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (VANOC);

(b)   Individuals who will be under 18 years of age as of August 31, 2009 (unless accompanied by a parent or guardian);

(c)   Individuals elected to public office.

·         Designated Representatives must consent to the use of their name, likeness, age, home-town and other identifying information for the purposes of this contest.

·         The odds of winning are dependent upon the number of entries received.  2010 Legacies Now estimates there are approximately 500 organizations eligible as Qualified Entrants.

·         Tickets to the 2010 Winter Games, whether awarded as a prize and/or are included as part of a promotion, must be accepted as awarded and are subject to all of the applicable terms and conditions prescribed to such tickets from time to time by the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (VANOC).  Such terms and conditions are contained in the Ticket License Agreement (which can be reviewed at www.vancouver2010.com), on the back of the physical ticket (once issued) and include prohibitions against any use of the ticket in connection with any commercial promotion or contest (without the consent of VANOC) and the unauthorized sale of the ticket in excess of face value of the ticket.  By accepting tickets as a prize and/or as part of a promotion, the holder is deemed to have accepted all of the applicable terms and conditions.

Other Conditions

·         The prizes must be accepted as awarded.

·         2010 Legacies Now reserves the right to disqualify entrants and/or entries and/or Designated Representatives that do not comply with these conditions.

·         2010 Legacies Now reserves the right to require proof of age and other qualifications of Designated Representatives.

·         2010 Legacies Now is not responsible for lost entries or entries submitted after the contest deadline.

·         Organizations must secure permission to use any individual identities, stories or information in the content of their entry form.

·         2010 Legacies Now is not responsible for any costs associated with claiming any prize.

·         The Winning Organization is solely responsible for the reporting and payment of any and all taxes, if any, that may result in claiming a prize in this Contest.

·         2010 Legacies Now may at their sole discretion alter, amend, suspend, or cancel this contest or amend the draw procedures at any time, subject to applicable law.

·         Decisions of 2010 Legacies Now are final on all matters of fact, interpretation, eligibility, procedure and fulfillment in respect to this Contest.

·         The Winning Organization consents to the use by 2010 Legacies Now of its identity for any lawful purpose, without further permission or remuneration.

·         Participation in this contest in no way provides Qualified Entrants with rights to market themselves or otherwise affiliate with the 2010 Winter Games in any way.

Winner Notification

·         The selected Winning Organization will be notified by email, mail or phone within 48 hours of the draw.

·         The selected Winning Organization will be required to acknowledge by phone, via email or in writing its receipt of the notification of eligibility for the prize and provide name of its designated representative at that time. If no response is received by 2010 Legacies Now within ten (10) business days of notification, the prize will be forfeited and may be awarded to an alternate winner by random draw from the remaining Qualified Entries.

 

Release

Before being declared a winner, a selected entrant may be required to sign a Declaration of Compliance with the Contest Rules and a Release of Liability, releasing LNS, VANOC, and each of their respective advertising and promotional agencies, any contest judging organization, parent companies and affiliates of the foregoing and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with this Contest or the Prize. Declaration and Release documents must be returned within the time period indicated in the documents or the Prize will be forfeited. Designated representative and their guest must also sign and return a Declaration and Release of Liability form prior to participating in this Prize and the name of guest cannot be changed once the Declaration and Release of Liability form has been received by LNS or its agent. 

General

·         2010 Legacies Now, their subsidiaries and affiliate companies and each of their respective directors, officers, employees, agents, representatives, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for:

(i)                 telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures or difficulties of any kind;

(ii)               failed, incomplete, garbled, or delayed computer transmissions;

(iii)             any condition caused by events beyond the control of 2010 Legacies Now that may cause this Contest to be disrupted or corrupted;

(iv)              any injuries, losses or damages of any kind arising in connection with or as a result of the prizes, or acceptance, possession, or use of the prizes, or from participation in this Contest; or

(v)                any printing or typographical errors in any materials associated with this Contest.

·         2010 Legacies Now reserves the right, in their discretion, to suspend or cancel this Contest at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of this Contest.  There is no guarantee that the prize package will be awarded.

·         2010 Legacies Now reserves the right to disqualify, in their sole discretion, any person or organization tampering with the entry process, the operation of the Web site, or who is otherwise in violation of the Contest Conditions. Any attempt to damage the 2010 Legacies Now website or undermine the legitimate operation of the Contest is a violation of criminal laws.

·         Prize must be accepted as is, is not transferable or convertible to cash, and may not be sold, traded or transferred. Should a winner refuse the prize, 2010 Legacies Now is released from any obligation and liability related to such prize.

·         If the prize cannot be awarded as described in these rules, 2010 Legacies Now reserves the right in their sole discretion to substitute a prize or prize component with another of comparable value (estimated cash value of up to $1,300).

·         By participating in this Contest, each participant agrees to release and hold 2010 Legacies Now, their subsidiaries and affiliated companies and each of their respective directors, officers, employees, agents, representatives, advertising, promotion and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with this Contest or resulting from acceptance, possession, or use of any prize, travel related thereto or from participation, including without limitation, personal injury, death, or property damage, and claims based on publicity rights, defamation, or invasion of privacy.  The Designated Representative and their guest will be required to sign and deliver to 2010 Legacies Now a form of similar acknowledgment and release, including verification of compliance with these contest conditions.

·         The contest entry form must be completed in English.

·         Should any entrant make any false statement in the Entry Form, it shall be automatically disqualified from the Contest.

·         Data contained in contest entry forms remain the property of the Entrant.  However by submitting an entry, the Entrant gives 2010 Legacies Now a world-wide, irrevocable, royalty-free license to reproduce, publish, adapt, communicate and broadcast all or part of the entry in any form and media, and to sublicense those rights (including to its partners). Supporting photos and video are permitted to illustrate the Entrant organization and are considered part of the contest submission and are subject to the same republication conditions as are data in the Entry Form.

·          Each Entrant agrees that it is representing and warranting to 2010 Legacies Now that:

(a)   the copyright in contents of the Entry Form is owned by the Entrant and does not violate the intellectual property rights of any third party; and

(b)   all necessary consents have been obtained from individuals referred to in the entry form concerning the potential use and disclosure of their personal information by 2010 Legacies Now.

·         This Contest is not available in the Province of Quebec.

No Association

Participation in this Contest does not grant the contestant any right to assert any association or affiliation with the 2010 Olympic Winter Games or Paralympic Games.
